1. Acceptance of Terms

By downloading, installing, or using Yapper ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the App.

We reserve the right to modify these terms at any time, and such modifications shall be effective immediately upon posting. Your continued use of the App will mean you accept those changes.

2. Description of Service

Yapper is a voice-based, location-specific social platform that allows users to share and listen to short voice recordings ("Yaps") from nearby users. All content is anonymous and temporary.

We do not guarantee that the App will be uninterrupted or error-free. We reserve the right to suspend or discontinue the App at any time without notice.

3. User Conduct

You agree not to use Yapper to:

• Post illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content
• Impersonate any person or entity
• Post content that infringes upon the rights of others, including intellectual property rights
• Share personal or identifying information about other individuals
• Collect or store personal data about other users
• Advertise or solicit goods or services
• Disrupt the normal functioning of the App

We reserve the right to remove content and/or terminate accounts that violate these guidelines.

4. Privacy

Our Privacy Policy, which explains how we collect, use, and disclose information, is incorporated into these Terms and Conditions. By using Yapper, you agree to our collection and use of information as outlined in the Privacy Policy.

While we emphasize anonymity, please understand that complete anonymity cannot be guaranteed in digital environments. We take reasonable measures to protect user privacy, but you should exercise caution in what you share.

5. Content and Ownership

By submitting voice recordings ("Yaps") to the App, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and distribute such content for the purpose of operating and improving the App.

You represent and warrant that you own or have the necessary rights to the content you submit, and that your content does not violate the rights of any third party.

6. Location Services

Yapper uses location data to provide its core functionality. By using the App, you consent to the collection and use of your location information. You can withdraw this consent at any time by disabling location services for the App in your device settings, but this will limit functionality.

We do not store precise location data longer than necessary, and we do not sell or share your specific location data with third parties for marketing purposes.

7. Limitation of Liability

To the maximum extent permitted by law, Yapper, its affiliates, and their respective officers, directors, employees, and agents disclaim all warranties, express or implied, in connection with the App and your use thereof.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of, or inability to access or use, the App or any content thereon.

8. Indemnification

You agree to defend, indemnify, and hold harmless Yapper, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of the App or your violation of these Terms and Conditions.

9. Governing Law

These Terms and Conditions shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located within the United States.
